Fellow Spirit ALPA Pilots,

As mentioned last week, custodian updates will be published each Friday when there is new information to report. The Custodian Team continues to enhance the spa.alpa.org page, so please check the site regularly as new information may be published at any time.

Pay Update

The Company has issued a paycheck for today, May 22. Company representatives have advised that there will be no traditional pay reports issued for this payroll. Grievances are being filed today over the lack of pay reports and the pay occurring later than May 15. Please reference yesterday’s Custodian Update for more information.

There were also two discrepancies identified on the check issued today (May 22, 2026). The April 321 Override calculation was incorrect. This error has been identified and will be rectified. The correct A321 Override amount for April is 4%. Furthermore, any pilot that had a JRM, X/Y, or CAP trip in the month of April was only paid 100% of that trip. The additional 100% of the pay will be paid next week along with the outstanding A321 Override. We anticipate those funds to be deposited by May 29, 2026.

Yesterday’s Custodian update walked each pilot through how to calculate the pay owed to them. The Custodian Team and the remaining Crew Pay volunteers have no access to any pay reports or company platforms to verify pay or audit your pay. If you did not download your April pay report, there is no way for us to retrieve them for you; they no longer exist.

After consulting the information provided in yesterday’s Custodian Update, pilots who still believe their pay to be incorrect should immediately file a Non-Compliance Complaint (NCC) and send a DART to the CrewPay Committee. We will do the best we can to attempt to rectify the outstanding issue; however, with the wind down, there frankly may not be anyone left at the Company to provide assistance. If no resolution is reached, a group grievance will be filed and ultimately become an administrative claim in the bankruptcy proceeding.

401(k)

As part of today’s paycheck, the Company indicated that we would receive the 8% defined contribution due to us under the collective bargaining agreement. However, per the Company, that money will be deposited directly into our 401(k) accounts as part of a “true-up” prior to plan termination. This true-up and final termination of the plan is scheduled to occur in mid-to late June 2026. To help assess and validate your final contributions please refer to previous Custodian reports that provide details about the reduced annual IRS limits that apply to both Pilot and Company contributions due to the mid-year termination of the plan.

Administrative and Pre-Petition Claims

There’s likely no money to pay either administrative claims (money owed for post-petition goods or services) or pre-petition claims. Administrative claims alone are estimated to amount to hundreds of millions of dollars, if not over a billion.

The secured noteholders have the first claim on Spirit’s assets. At present, these secured creditors are under secured – they are owed more than the value of their collateral. Under the Bankruptcy Code, they have the right to be paid in full before any other creditors receive anything. The secured noteholders are spending some of their money to wind down the Company. Because they are entitled to everything, at this point we think it is unlikely that any money will be paid on administrative claims or pre-petition claims.

Vacation and Sick Bank Payouts

On the paycheck issued today May 22, there were no sick or vacation bank monies paid for payouts due under the collective bargaining agreement. The custodians continue to press the Company to pay out the vacation and sick banks. While the Company has not yet provided a definitive answer on whether or not we will receive payment for these banks, formal grievances have been filed out of an abundance of caution

WARN Notice

There have been many questions on the class action lawsuit filed in response to alleged improper WARN notification by Spirit Airlines. ALPA’s Legal Department is analyzing this issue and will provide further updates soon.

Furthermore, please know that a group grievance has been filed relating to the violation of CBA 23.A.3.

Non-Compliance Complaints (NCCs)

The custodian team and ALPA staff from the Representation Department met with the Company this week to discuss our outstanding NCCs. The Company representatives advised that all NCCs have been denied. Therefore, the denied NCCs will either be included with the existing grievances or converted into grievances and filed with the Company.  

Grievances

The Custodian Team also met with the Company to discuss outstanding grievances. Keep in mind our outstanding grievances are in two buckets: pre- and post-petition.

Our pre-petition grievances have been accounted for, their values estimated and filed with the bankruptcy court.

Our post-petition grievances are in the process of being valued and will be filed with the bankruptcy court prior to the administrative claims bar date.

General Updates

The MEC office is now closed, and the phone line is no longer monitored. Please remember that the best way to communicate with the custodian team is via DART. The DARTs are monitored and will be responded to.

The merger fund is being audited for return to the membership. Once the audit is complete, we will communicate the process for return.

We understand and empathize with the frustration and angst surrounding the shutdown of our airline. We know that each of you are moving through the grieving process in your own ways.
